    look at it like this if he has a tv set near his window is it illegal to watch it if i can see it from my house. same thing. im not stealing anything he is giving it away for free.

              Nope people here in Texas have been arrested for this too. Although there is not an exact and specific law against it, arrests have been made under some very streched interpretation of the Computer Fraud and Abuse Act CFAA. Most get overturned and the defendat goes free, but man the problems that comes with proving you are not doing anything illeagal. I would reather pay for my own service or use a wifi that I have permission to get on.

                  A wireless router is a device that performs the functions of a modem but also includes the functions of a wireless access point.

                    • forgot to add one more thing, maybe the guy leaves it open on purpose. I was talking to one of the IT guys where I work and he said he always leaves his wifi open so that other people can use it. he did say that he has ways of monitoring what people do on his network though. So here you are calling this person a dumbass and it's very possible that he's just trying to be neighborly and do everone else a good service. He may know you're on it and just doesn't care aas long as you keep you actions legal.

                          I would interpret the definition of computer to mean it is included since it is communication equipment connected to the computer itself. But like I said earlier it boils down to interpretation... agree to disagree?
