Nope people here in Texas have been arrested for this too. Although there is not an exact and specific law against it, arrests have been made under some very streched interpretation of the Computer Fraud and Abuse Act CFAA. Most get overturned and the defendat goes free, but man the problems that comes with proving you are not doing anything illeagal. But the way I see it is your packets are transmitted and received from your computer to the other person's computer. The other person's computer is connected in a network between their computer and the ISP computer. Your data packets access their network.
I still say its wrong and illegal but thats the way I see it... doesn't mean I don't do it every now and then though...

forgot to add one more thing, maybe the guy leaves it open on purpose. I was talking to one of the IT guys where I work and he said he always leaves his wifi open so that other people can use it. he did say that he has ways of monitoring what people do on his network though. So here you are calling this person a dumbass and it's very possible that he's just trying to be neighborly and do everone else a good service. He may know you're on it and just doesn't care aas long as you keep you actions legal.Haiku's are easy
