  • Instead of 20 millions clubs........

Why not just one? Hell, if we need  a central location to meet I can offer my spot for awhile. Having one local area club is better. Also, we can rotate the meeting location monthly or how ever and start tank tours.

    Just my two cents...

IMO, that's HAS for the most part.  I'm not wanting to compete with HAS.  I'm just looking for a group to meet somewhat locally to where I live.  Not everyone is willing or is able to drive 30 minutes downtown or like me, an hour to Huffman for the LHA.

Two people are friends. It only takes three people to make a club. For a not for profit organization one needs to be president, one treasurer and one secretary. Filing fees are less than $75. I may not be able to meet with 20 million fish clubs all of the time. There is only one of me but I am willing to help someone else start a fish club.

OMG yall might as well call it a bridge club play cards while you talk about your tanks. why even have to name it anything. just say we are having a fish party at EK's place and everyone near him can come. and then Raul you can through one for your area, and then a few times a year, we all draw straws for the location and have a big swap or somethin. Honestly tours are all good and such but sometimes they just get odd, like the big weird display at gallery, there isnt a theme to that at all and it just makes my artistic side ache. Now if i could get a little more posting size allowance  i could post more on here. or i could take lower size pics    but back to the "clubs" why not ask to have a little section for each quadrant of the city, NW, NE, SW,SE and and they meet by-monthly and a location central to all quadrants, by making them bymonthly you would be able to avoid conflict with LHA and then have it be open attendence, up to each quadrant to organizes its meeting.

As in do they have food or not, or drinks available (adult or normal) and go from there, and then they can all get together for big swaps and or auctions. that way we can all get more organized without driving all over city all the time.

I would be happy to organize the SW group of the Houstonfishbox CLUB. huh how does that name sound, or course would have to ask Ken's permision. but we met on here, might want to give the site a little credit, and it would give people the option of a city wide club with localized meetings and one that has a much easier to use website

Re: Instead of 20 millions clubs........

Privately some are asking how to set up a club legally so:

                          Step 1:
A non-profit corporation is created by filing articles of incorporation with the secretary of state in accordance with the Texas Non-Profit Corporation Act (TNPCA), articles 1396-3.02 and 1396-3.03. "Non-profit corporation" means a corporation no part of the income of which is distributable to members, directors, or officers (TNPCA, article 1396-1.02A(3)).

This basically means nothing belongs to me or the board of directors and if the club is disolved everything must be given to a not for profit organization or the state.

Two copies of the signed articles of incorporation should be submitted to the secretary of state for filing. The filing fee for a non-profit corporation is $25.00.

Not all non-profit corporations are entitled to exemption from state or federal taxes. The secretary of state, however, does not make such determinations.
You should consult the Internal Revenue Service (IRS) prior to filing the articles to determine what provisions must be included in the articles for the corporation to be exempt from federal taxes. IRS Publication 557, titled "How to Apply for Recognition of Exemption for an Organization," describes the rules and procedures for non-profit organizations requesting exemption. The publication can be obtained from either the IRS or the Government Printing Office. You also may wish to visit the IRS web site at http://www.irs.gov/eo for further information on obtaining tax-exempt status.
A non-profit corporation may be exempt from the payment of state franchise taxes if its purposes fall within one of the exemptions listed in the Texas Tax Code, Chapter 171, Subchapter B. Questions on exemption procedures should be addressed to:
                          Comptroller of Public Accounts
                          Tax Assistance
                          Exempt Organizations Section
                          Austin, Texas 78774-0100
                          (512) 463-4600 or (800) 252-1381
                          TDD: (800) 248-4099 or (512) 463-4621
ARTICLES OF INCORPORATION FOR A NON-PROFIT CORPORATION
The secretary of state has promulgated a form designed to meet the minimal filing requirements of the relevant statutory provisions; use of this form is permissive. This form may not meet the particular requirements of a specific transaction. This form does not contain certain provisions or statements required by the IRS when determining tax-exempt status. If you plan to seek a federal tax exemption, you may wish to obtain further information from the IRS before use of any standardized form. The form and the information provided is not intended to provide legal or business advice and is not a substitute for the services of an attorney or tax specialist. If you have concerns or legal questions regarding a specific transaction, you should consult a private attorney.
The link to the form on the website is broken but you need form 202 from here:

If you email guppymax@msn.com and ask I will send you a copy of the form 202 that we, the HLA filed to become a not for profit corporation.

                          Step 2.

The next step is to file an assumed name or DBA. This protects your right to the business name you choose ie. The name Houston Livebearers Association belongs to the members not me and not the board of directors. You can do this at any of the county clerks offices and I believe the price is $16:

                          Step 3.

This step is to get a sales tax permit to collect state sales tax. Generally speaking you will need to collect tax on all sales and will not make enough money to pay franchise tax or federal income tax. You can get the sales tax permit online:

The Texas Comptroller of Public Accounts has rebuilt its website with customers in mind. The tools you use most are now just a click away, allowing you to quickly file and pay taxes, search for unclaimed property, find state purchasing information and much more.

If I remember correctly they give you a little contact information package when you do step 2 that lets you do this by mail as well.

                          Step 4.

Steps 1, 2 and maybe 3 are prerequisite to 4. Get a bank account so you can cash a check made out to your organization. A Pay Pal account and credit card may be necessary as well depending on what you want to do.

                          Step 5.

Later when you make more income, the HLA is just now getting there you will need to file for federal income tax exemption. The state basis exemption from sales tax and franchise tax on your having federal income tax exemption. The filing fee for federal income tax exemption is $300 so for now forget steps 5& 6.

                          Step 6.

Get sales tax exemption and franchise tax exemption. You may still have to charge tax on sales. This is complicated and beyond the scope of starting a new club.

Yes, it seems wrong for the government to try to support itself off of little struggling not for profit clubs. I think the $300 fililng fee is outrageous when the state uses that for sales tax exemption. I try to obey the law anyway.
